Wayfinding Privacy Policy

LogicJunction Inc. (“LJ”) offers digital wayfinding software along with related information and services to assist users including visitors and patients at the hospital or other healthcare facility for which the Sites (defined below) are configured (the “Facility”). The Facility licenses the Sites and owns the data thereon.

Information is provided via a combination of the Facility’s wayfinding website , (the “Website”), Kiosks at the Facility, and the mobile application (“App”) (collectively, the “Sites”) as a service to visitors and patients at the Facility, as well as those who download and/or use the Sites (“User” or “you”) subject to this LJ Privacy and Security Policy (the “Policy”). Please refer to privacy policies posted by the Facility for additional information.

LJ is committed to protecting the privacy and security of your information while you use the Sites. As a User, you are agreeing that you have read, and understood, and agree to comply with and be bound by this Policy.

In this Policy, LJ will inform you about the type of information that is collected about you on the Sites, how it is collected, what it will be used for, and to whom it will be given. This Policy will also tell you how you may limit our use of your personal information.

This Privacy and Security Policy is, incorporated into the LJ Terms of Use (where applicable) and certain capitalized terms are defined in the Terms of Use.

Users need not register for the Sites and activity data is anonymous unless the User opts to share personal information, which may include a name, email address, postal address or other information that can be used to personally identify a User as defined under various laws (“PI”). By using the Sites, you are consenting to these terms and the use and processing of your PI within the United States. Where required by law, we will obtain your explicit consent to the collection or processing PI.

We may need to update this Policy to keep pace with changes in the Sites, our business and/or the law, however, we always maintain our commitment to respect your privacy.

What Kind of Information LJ Collects:

LJ will not obtain personally-identifying information about you when you visit our Sites, unless you choose to provide such information to us. You may have the option, where applicable, to submit information to the Sites by sending an email or submitting information through certain forms available on the Website and App. You need not provide any PI to access the Sites, however, in order for Facility to communicate with you, PI such as your contact information may be submitted.

The following table describes how we directly (along with the Facility and third-party subcontractors with their own secure privacy practices) use certain User information in order to perform services:

Type of Information How and Why We Use It

User-provided information submitted through forms on the Sites, including ratings, comments and contact information. To gather information about the Sites’ performance and improve them with your observations and suggestions.
Information about your browsing, including: the Internet address of the website from which you linked to the Sites, the date and time you accessed the Sites and other non-identifiable information. To gather anonymous statistics with which to analyze and improve the Sites’ performance.
Technical information, including: information about your device (hardware type, hardware identifier, device make and model, operating system version, app version, web browser information, unique device ID (persistent / non-persistent), media access control (“MAC”) address, international mobile equipment identity (“IMEI”). To gather non-identifiable statistics with which to analyze and improve the Sites’ performance.
Location data including starting location, destination location and where applicable real time location information based on the User’s Internet Protocol (“IP”) and/or through GPS, geomagnetic data, a Facility’s Bluetooth (BLE) Beacons and Wi-Fi. To deliver requested content, assist Users in reaching their destination and provide other relevant and requested information.
Non-personally identifiable, aggregated, information, including: what pages of the Sites you choose to access, traffic patterns, demographics, and other statistics about our site and our Users. For analytics, optimization and to assist us in improving the site.
Sharing User Information
Except as described below, only anonymized or aggregate data is shared with external services to enable the performance of the Sites, however we reserve the right to share any and all information, including PI, with the Facility.

We only share your PI with outside parties when:

You have provided your explicit consent to share the information.
We use a third party in order to perform the service you requested.
We use a third party subcontractor with its own secure privacy practices, for LJ business functions.
We are required by law to provide your information or we find that your actions on the Sites violate our terms of use to the extent that an outside investigation in warranted.
We believe doing so is necessary to protect the rights, property, or personal safety of LJ, the Facility or others.
We sell or otherwise transfer such information to a successor or subsidiary of LJ.
We will provide you with notice if we believe we are compelled to comply with a third party’s request for information.

Security

We take the security of all personally identifiable information obtained through the Sites seriously. Only those who require such information to serve the purposes described above may access it, and only when subject to strict confidentiality.

We use industry standard encryption, e.g. secure socket layer (“SSL”) technology. When we receive your data, we protect it using a combination of administrative, physical, technical and logical security safeguards.

While the acts of third parties are not within our control and 100% security can never be guaranteed, one can reduce risks by using anti-virus software and password protecting all computing devices that you use with the Sites.

We have procedures in place to deal with any suspected data security breach. Where we are legally required to do so, we will notify you and any applicable regulator of a suspected data security breach.

Cookies

A “cookie” is a small file sent from a web server to your browser and is stored on your device when you visit certain websites and applications to save visitor preferences and other information. You can configure your browser to refuse cookies. We reserve the right to use cookies on the Sites.

Your Data Collection Rights

LJ is committed to the following rights regarding the information you submit:

Fair processing of information, minimizing PI collected, and transparency over how we use your PI.
Providing access to and copies of your PI, correction of mistakes, opt-out and erasure of PI on request.
If LJ processes your PI for purposes other than those specified in this Policy, we will notify you of such changes.

Data Retention

We retain your PI for the period necessary to fulfill the purposes outlined in this Privacy and Security Policy, unless a longer retention period is required or allowed by law or to otherwise fulfill a legal obligation.

Opting-Out, Accessing and Deleting your PI

To stop the collection of location position data on most devices, you may disable your GPS, Bluetooth (Sensors), Wi-Fi and location settings. Note that features such as mapping may not work properly if you disable those settings.

You may opt-out of having any applicable PI collected or used by contacting us at dpo@purple.ai or by contacting the Facility. In addition, you may ask the Facility to delete your PI. Please note that in order to fulfill certain obligations, we may need to continue sending you notices or other important information.

Requesting Your Information and California Online Privacy Protection Act Compliance
Because we value your privacy, we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. In addition to the information we’ve provided above, on request we can provide more information about (i) the information we collect and how third parties use it, (ii) contact information and addresses of such third parties and (iii) information about the products or websites those third parties market. Please indicate “LJ California User Choice Notice” on the subject line of any such request. Once you receive this information, you may request that we modify or remove any of your personal information. We reserve the right to verify your identity before sending you this information.

“Do Not Track” Browser Signals

We currently do not actively respond to Do Not Track browser signals and do not authorize the collection of PI from Users through technologies deployed in promotions on the Sites.

Access to Children

There are no features of the Sites specifically directed to, and we do not knowingly collect information from, children under the age of 16.

Changes to This Privacy and Security Policy

We reserve the right to change this policy at any time to keep pace with changes in LJ, the Facility, or the law. We will post any revisions to this Policy, along with their effective date, in a prominent area of the Website and App. We ask that you check back from time to time to ensure you are familiar with the most current version of it. Your continued use of your account after any change means that you agree with, and consent to be bound by, the updated Privacy and Security Policy. If you disagree with any changes in this Policy you have the option to terminate your account.

LJ has appointed a Privacy / Data Protection Officer who is accountable for the compliance with these privacy principles as applies to LJ, and can answer any questions you may have. In addition, you may feel free to file a complaint directly with us via our website, or we can direct you to the relevant government authority.

Jurisdiction and Data Storage

Please be aware that content submitted to LJ will be transferred to a data center in the United States. If you post PI to the Sites, you are confirming your consent to such information being hosted and accessed in the United States. Privacy laws or regulations in your country may differ from those in the United States, where LJ operates from and whose laws govern this Privacy and Security Policy.

Acceptance of Terms of Use and Privacy and Security Policy

By using the Website and/or downloading the App, you agree to the terms as well as any posted changes of these Terms of Use and Privacy and Security Policy. By using the Sites, you hereby consent to the collection and use of this information by LJ.

If you do not agree to the terms and conditions herein, YOU MAY NOT use these Sites.
